The debate over judicial review of legislation is profuse. But differences are often due to the lack of a common methodology. This article discusses the proper way to evaluate judicial review and confronts central challenges raised against it. It develops the two main models that can be used for analyzing the intersection between democracy and constitutional decision-making and shows that judicial oversight may not be rejected, regardless of how we interpret that connection. The article discusses in detail the model developed (...) by Jeremy Waldron. A nice attempt to answer methodological questions, Waldron's model wrongly tips the balance against judicial review. Its excessive level of abstraction and idealization renders it inoperable. Few systems meet its standards, and those that do pay a high price: they contradict the concept of democratic legitimacy that underlies the model. The paper has been written from a philosophical perspective and triggered by the recurrent discussions in psychology about the most suitable methods to study our multifaceted subjectivity. Its main point is that a phenomenological understanding of the human person provides a robust and also flexible philosophical framework for psychology. The first part discusses three classical distinctions –individual/general; explaining/understanding; induction/interpretation– which, in spite of possible deficiencies, are useful to illustrate the specificity of the human sciences relative to the natural sciences. If (...) not understood as an either-or dichotomy these distinctions represent the search of the right balance to reflect the complexity and richness of psychological science. The second part presents the phenomenological notions of ‘vital reduction’ and ‘personalist reduction’, where reductions does not take on an eliminativistic meaning, but of directing the mind’s gaze to attend to what is originally the case. The ‘vital reduction’ reveals a subject of experience at the center of the lifeworld, and the ‘personalist reduction’ sees in rationality –i.e., the power to grasp the meaning of things and to recognize other subjects of experience­– a deeper dimension of the subject, who we can thus call a person. Psychology and phenomenology converge in disclosing the person-centeredness of our lifeworld. (shrink)

COVID-19 has resulted in extraordinary disruptions to the higher education landscape. Here, we provide a brief report on 295 students’ academic perceptions and emotional well-being in late May 2020. Students reported the high levels of uncertainty regarding their academic futures as well as significant levels of stress and difficulty coping with COVID-19 disruptions. These outcomes were related to the higher levels of neuroticism and an external locus of control. Female students reported worse emotional well-being compared to males, and the students (...) of color reported the significantly higher levels of stress and uncertainty regarding their academic futures compared to White students. These results suggest that some students may be at particular risk for academic stress and poor emotional well-being due to the pandemic and highlight the urgent need for intervention and prevention strategies. In this work we review the three principal theses that Ignatio Vincentio, a Spanish thinker of the seventeenth century, defends about the agent intellect: 1) it is the same potency as the possible intellect, only with a formal distinction and plurality of names; 2) it has three tasks: a) to illuminate phantasmata, b) to make them intelligible in act, and c) to abstract the intelligible species from them; and 3) it will remain in the separated soul performing the same task (...) as in the present situation [?], but without conversion to phantasmata. Rosmini’s philosophy is a comprehensive effort toward the renovation of Christian thought in modern times. An intense discussion of the problem of knowledge led him to reformulate Augustine’s theory of illumination in terms of the ideal presence of universal being to the mind. Universal being is the lumen intellectus and our mind’s first object: it is implied in all our thoughts and makes them possible. Although devoid of reality, it shows remarkable features, such as infinity, necessity, and eternity. Without being (...) God, it may be called “divine,” and confers a special value to intelligent creatures, whose dignity comes from their being enlightened by universal being. The “divine” is also the seal of God’s presence in nature. The present article supports the logic of this argument. (shrink)

According to kin selection theory, indirect reproductive advantages may induce individuals to care for others with whom they share genes by common descent, and the amount of care, including self-sacrifice, will increase with the proportion of genes shared. Twins represent a natural situation in which this hypothesis can be tested. Twin pairs experience the same early environment because they were born and raised at the same time and in the same family but their genetic relatedness differs depending on zygosity. We (...) compared the degree of willingness to fight and sacrifice for the co-twin among monozygotic and dizygotic pairs in a sample of 1443 same-sex and opposite-sex twins. We also analyzed the effect of the subject’s gender and that of the co-twin on those altruistic behaviors. Results partly supported the postulated explanation. MZ twins were significantly more likely than DZ twins to self-sacrifice for their co-twins, but zygosity did not affect willingness to fight for him/her. The genders of the subject and of the co-twin, not genetic relatedness, were the best predictors of aggressive altruistic intentions. (shrink)

BackgroundDistorted gambling-related cognitions are tightly related to gambling problems, and are one of the main targets of treatment for disordered gambling, but their etiology remains uncertain. Although folk wisdom and some theoretical approaches have linked them to lower domain-general reasoning abilities, evidence regarding that relationship remains unconvincing.MethodIn the present cross-sectional study, the relationship between probabilistic/abstract reasoning, as measured by the Berlin Numeracy Test, and the Matrices Test, respectively, and the five dimensions of the Gambling-Related Cognitions Scale, was tested in a (...) sample of 77 patients with gambling disorder and 58 individuals without gambling problems.Results and interpretationNeither BNT nor matrices scores were significantly related to gambling-related cognitions, according to frequentist analyses, performed both considering and disregarding group in the models. Correlation Bayesian analyses largely supported the null hypothesis, i.e., the absence of relationships between the measures of interest. This pattern or results reinforces the idea that distorted cognitions do not originate in a general lack of understanding of probability or low fluid intelligence, but probably result from motivated reasoning. The counterfactual thinking cannot be only developed in early childhood, but it also could be a requirement for the causal reasoning. In this research a replica of German was made using counterfactual stories with Latin American kids between three and four years, demonstrating the possible main role counterfactual reasoning, by using computer animations. This was a different approach to the most recent made by Nyhout and Ganea. Nonetheless, the participants of the study evidenced counterfactual reasoning to the relevant choice and (...) the negative consequence conditions shown on the stories that represented the choices made by a starting role. Although some of the results were not totally conclusive under the analyzed conditions. Lastly, some possible not controlled effects are discussed from stories shown to the children, that could have motivated the counterfactual thinking. (shrink)

Automatic public malware analysis services provide controlled, isolated and virtual environments to analyse malicious software samples. Unfortunately, malware is currently incorporating techniques to recognize execution onto a virtual or sandbox environment; when an analysis environment is detected, malware behaves as a benign application or even shows no activity. In this work, we present an empirical study and characterization of automatic PMAS, considering 26 different services. We also show a set of features that allow to easily fingerprint these services as analysis (...) environments; the lower the unlikeability of these features, the easier for us to fingerprint the analysis service they belong to. Finally, we propose a method for these analysis services to counter or at least mitigate our proposal. (shrink)

Este artículo presenta una reflexión respecto a la dimensión política de quienes ejercemos la labor bibliotecaria o bibliotecológica, enmarcada en la educación inclusiva del Sur Global, donde se parte del reconocimiento de la labor bibliotecaria y bibliotecológica asociada, generalmente, con un conocimiento práctico de las cosas o techné, debido a las condiciones históricas en que la disciplina científica se consolidó como tal. Empero, cada vez más se hace necesario que esta labor se proyecte de manera consciente y decidida hacia el (...) afianzamiento de la bibliotecología como campo de conocimiento necesario y útil para el logro de los principios sociales de la democracia, la justicia social y los derechos humanos; reconociendo, así, su dimensión política. Inicialmente se presenta una introducción histórica a la bibliotecología como ciencia. Después, se expone el significado sobre ser bibliotecario en Latinoamérica a la luz de las funciones sociales de la biblioteca y la bibliotecología. A continuación, se interpela la necesidad de que quien ejerce la labor bibliotecaria debe ser un sujeto político, incluso a pesar de sí mismo. Como preámbulo al cierre se presentan, a través de casos específicos y manifestaciones de acción social comunitaria, ejemplos de la dimensión política del bibliotecario. Finalmente, se cierra con una serie de propuestas y desafíos para trabajar en el fortalecimiento de una práctica política en la labor bibliotecaria o bibliotecológica en el Sur Global. (shrink)

El coaching ejecutivo ha dado lugar a numerosos desarrollos de orientación básicamente prescriptiva. Una perspectiva crítica y con base empírica puede permitir ir más allá de la retórica del coaching e identificar las tensiones y las contradicciones de los procesos de coaching en un contexto organizacional, como entorno relacional y cultural. El objetivo de este trabajo es acercarnos críticamente al coaching ejecutivo individual en la práctica, estableciendo las diferencias entre lo preconizado por las teorías y los expertos del coaching y (...) lo que se hace en las empresas. Mediante 50 entrevistas en profundidad a coaches y coachees, identificamos cuatro grandes discursos sobre el coaching ejecutivo: a) herramienta de crecimiento personal; b) relación diádica; c) resolución de problemas en equipos de trabajo; y d) mecanismo de cambio organizacional. El análisis muestra las tensiones y las contradicciones ad intra y entre los discursos y, con ello, la importancia de considerar el contexto organizacional. (shrink)

In this article, we study Latin American populist constitutions and their uses, seeking to analytically understand whether populist constitutionalism is, indeed, a thing. We posit that Latin American populist constitutionalism is a particular form of mixed constitutionalism in three senses: first, as a specific combination of substantive traits that includes both empowering and constraining devices; second, as a peculiar politics of constitutional change that incorporates popular mobilization against pre-existing institutions as a key trait; and third, as a particular practice of (...) constitutional enforcement that involves weak and selective implementation, often through institutional capture. By considering not only the texts of constitutions but also the ways in which they are changed and implemented, we hope to complement legal perspectives of mixed constitutions with a sociopolitical analysis of practices and contexts. By capturing the distinctive contribution of Latin American populism to the discussion of mixed constitutions, we seek to challenge both legal conceptions of constitutionalism that reduce it to negative or constraining features, and political conceptions of populism that simply equate it to authoritarian rule. The present work analyzes the various expressions of the corporeal condition of human existence, from the complex, social and cultural construction of the subject and the subjectivities in Modernity, and works the metaphors of bodies (in their soma and in their psyche which are intimately linked with embodiment) disdained, mutilated and painful that are put on the scene of Latin American society, projecting what is admitted and what is forbidden, in the places of memory of resistances and dominations. Here, a (...) problematic relationship is drawn to the order and corporeal cosmos of history and society; In this way, the book expands an analysis by an inter and transdisciplinary history of the body in terms of symbolic construction and power-knowledge relations, which make it a field of events, a terrain of marriage of technical, linguistic and psychosocial devices in the aesthetic and suffering framework of the human and in the processes of subjectivation of the world. According to proponents of irreducible cognitive phenomenology some cognitive states put one in phenomenal states for which no wholly sensory states suffice. One of the main approaches to defending the view that there is irreducible cognitive phenomenology is to give a phenomenal contrast argument. In this paper I distinguish three kinds of phenomenal contrast argument: what I call pure--represented by Strawson’s Jack/Jacques argument --hypothetical-- represented by Kriegel’s Zoe argument --and glossed-- first developed here. I argue that pure and hypothetical phenomenal (...) contrast arguments face significant difficulties, but that there is a sound glossed phenomenal contrast argument for irreducible cognitive phenomenology. We determine the number of non‐isomorphic semi‐Heyting algebras on an n‐element chain, where n is a positive integer, using a recursive method. We then prove that the numbers obtained agree with those determined in [1]. We apply the formula to calculate the number of non‐isomorphic semi‐Heyting chains of a given size in some important subvarieties of the variety of semi‐Heyting algebras that were introduced in [5]. We further exploit this recursive method to calculate the numbers of non‐isomorphic semi‐Heyting chains with (...) n elements such that removing the mth element () we are left with a subalgebra. We also solve a related problem posed in [1] of determining the number of ways a semi‐Heyting chain with elements can be extended to a n element semi‐Heyting chain by adding a new element in the mth place. Finally we combine these results by finding a second way to calculate the numbers that provides some extra information. (shrink)

Turing was an exceptional mathematician with a peculiar and fascinating personality and yet he remains largely unknown. In fact, he might be considered the father of the von Neumann architecture computer and the pioneer of Artificial Intelligence. And all thanks to his machines; both those that Church called “Turing machines” and the a-, c-, o-, unorganized- and p-machines, which gave rise to evolutionary computations and genetic programming as well as connectionism and learning.
